Die Arbeit untersucht die Sinnhaftigkeit und Zulässigkeit der Rechtswegwahl im Staatshaftungsrecht. Angestoßen durch den Entwurf eines sog. Adhäsionsverfahrens, stellen sich allgemeine Fragen der Zuständigkeitsverteilung auf Rechtswegebene und konkret im Staatshaftungsrecht, die sich sowohl rechtspolitisch als auch rechtsdogmatisch betrachten und beantworten lassen. Im Fokus steht hierbei auch die Frage, inwiefern Art. 34 Satz 3 GG einer Neubetrachtung der Rechtswegabgrenzung entgegensteht.

Initiated by the draft of a so-called adhesion procedure, questions of the allocation of jurisdiction arise, which can be considered and answered both in terms of legal policy and legal doctrine. The focus here is also on the question of the extent to which Art. 34 sentence 3 of the Basic Law (Grundgesetz) precludes a reconsideration of the division of jurisdiction.
